Acceptance of Terms

By accepting Jweeb Solutions Terms of Service (TOS) electronically or in writing, and/or by using the services offered by Jweeb Solutions, you (client) agree to be bound by the following terms and conditions.

Jweeb Solutions provides its services to its clients subjected to the following TOS, which may be updated from time to time without notice. Client should periodically review the most current version of the TOS at http://www.jweeb.com.sg/tos.html. Failure to comply with the TOS may result in a contract, service and/or account termination.

Client's acceptance of the TOS is binding upon all Jweeb Solutions services including the purchase of additional services or accounts at a later date.

Design Services

Design is defines as a process of illustrating a concept. Design services include, but not limited to: Web Design, Print Design, Graphics Design and Industrial Design.

Acceptance of Design Service
The acceptance of a design service by the client is through the approval of the quotation that is approved in writing through email, letter or fax. The design job is only confirmed upon the receipt of the client's acceptance in writing, as well as an acknowledgement by Jweeb Solutions that the acceptance is received in writing. Jweeb Solutions will only begin any design works upon the receipt of deposits, if any.

Payment, Cancellation and Refunds
Upon the acceptance of the design service, the client is liable for all payments made and all outstanding payments. Refunds or cancellations of the design job are provided, only when approved or endorsed by a management of Jweeb Solutions. Late payment charges will be charged at 10% of total outstanding payment with an administrative fee of $25/- (inclusive of GST) if payment is received after 28 days.

Delivery of Completed Designs
The design Designs would only be transferred to the ownership of the client upon completion of the design, as well as a complete payment of the quoted price. Completed designs would be provided in a raw Adobe image format (.ai, .eps, .png, .psd), as well as a compressed image format (.jpg, .gif), otherwise specified.

Deliverables
The delivery of the product or service to the customer would be defined in the agreement or contract under the heading "Deliverables".

 

Shared Web Hosting Services

Web Hosting is the storage of website files on a server that is connected to the World Wide Web that allows a user connected to the World Wide Web to access the files. In shared web hosting, numerous web sites are shared on one server.

All services provided by Jweeb Solutions ("Jweeb Solutions") may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any Singapore law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Jweeb Solutions from any claims resulting from the use of service which damages the subscriber or any other party.

Prohibited are sites that promote any illegal activity or present content that may be damaging to Jweeb Solutions' servers, or any other server on the Internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

hacker programs or archives
Warez sites

NOTICE: IF YOUR ACCOUNT IS FOUND TO CONTAIN ILLEGAL ACTIVITY, ILLEGAL MP3 FILES, PIRATED SOFTWARE, HACKER PROGRAMS, WAREZ PROGRAMS, OR ANY OTHER ILLEGAL FILES, YOUR ACCOUNT WILL BE TERMINATED IMMEDIATELY, WITHOUT NOTICE, AND A S$50.00 CANCELLATION FEE WILL APPLY. ADDITIONALLY, Jweeb Solutions WILL NOTIFY THE PROPER AUTHORITIES OF YOUR ACTIONS.

Traffic Usage
All account plans come with a predetermined amount of traffic allowance. We monitor all accounts and susbend the account if traffic is exceeded.

IRC
We currently do not allow IRC or IRC bots to be operated on our servers.

Chat Rooms
We currently do not allow chat rooms to be operated on our servers.

Music, Video & Multimedia Streaming
We currently do not allow any music, video and/or multimedia streaming to be operated on our servers.

Scripts
Services under the Host ‘n’ Smile brand do not allow any form of scripts such as but not limited to php, ruby-on-rails, cgi-bin, frontpage extensions to be operated on our servers.

Server Abuse
Any attempt to undermine or cause harm to a server or customer of Jweeb Solutions is strictly prohibited. As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled without chance of refund.

Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion.

All sub-networks, distributive hosting sites and dedicated servers of Jweeb Solutions must adhere to the above policies, with the exception of system resources in respect to dedicated servers.

Billing
By the Account Activation Date of each month, Jweeb Solutions shall deliver, by e-mail or regular mail, an invoice in accordance with the applicable Service Fees for services rendered for the current month. When an invoice is delivered to the client, payment shall be remitted to Jweeb Solutions by no later than the specified payment due date. Jweeb Solutions shall be entitled to immediately terminate this agreement for client's failure to make timely payments. You will be provided with an invoice on a monthly or annual basis, depending on the plan’s subscription. In the event that there payment is rejected (i.e. cheque bounce, bank transfer did not go through), we will send an e-mail notification, at which point the customer will make a payment within 3 days. If we do not receive a response within 3 days, the account, and all accounts under that account plan, will be suspended.

Service Fees
Certain services carry a setup fee charged by Jweeb Solutions to client, which must be paid by client in order to have use of said services. If client terminates this agreement, client shall be responsible for any and all outstanding fees owed to Jweeb Solutions and agrees to pay any and all fees incurred by client. Because the services are provided on a monthly or annual basis, the client will be responsible for service fees incurred each month or year respectively, regardless of when client provides notice of termination. Thus, for example, if the client provides notice of termination on the 15th day of a particular month, the client will be responsible for service fees for the entire month, and such fees will not be pro-rated or refunded.

Money back guarantee & refund policy
We do not generally refund cancelled contracts. For example, if your contract is quarterly and you request a refund after two months, no refunds will be admitted. No refunds are issued for setup charges, add-on charges, domain-registrations, add-on purchases, SSL certificates or overage charges. In case of AUP violations, any and all refunds are forfeit.

Upgrading of Account
A service charge of S$10 would be required for any upgrading of accounts to a higher plan.

Downgrading of Account
We DO NOT allow any downgrading of plans until the contract is over.

Account Deactivations
Any account deactivated due to non-payment will require a reactivation fee of S$25.00 prior to reactivation.

Cancellation Refunds
We DO NOT refund partial monthly fees to accounts. We require 30 days notice for a cancellation.

Refusal of Service
We may refuse, cancel or suspend an account or service, at our sole discretion.

Services Rates
We may proactively change the rates and charges from time to time.  

Back-Ups
Jweeb Solutions is not responsible for any data that is damaged, deleted or misplaced hosted on our servers. Although RAID harddisk solutions are provided, it is by no means a gurantee of the safekeep of data on our services. The client is adviced to do a local backups on their local computers, and system backups using the control panel provided. Should a high data integrity solution be required, the client can contact Jweeb Solutions for appropriate hosting redundancy and backup solutions.

Limitation of Liability
Jweeb Solutions shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Jweeb Solutions ' servers going off-line or being unavailable for any reason whatsoever. Furthermore, Jweeb Solutions shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Jweeb Solutions ' servers. All damages shall be limited to the immediate termination of service.

Violations
Violations of these Acceptable Use Policies should be referred to general@jweeb.com.sg. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.

Disclaimer
Jweeb Solutions cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain services provided by Jweeb Solutions are resold. Thus, certain equipment, routing, software and programming used by Jweeb Solutions are not directly owned or written by Jweeb Solutions. Moreover, Jweeb Solutions holds no responsibility for the use of our clients' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as Jweeb Solutions sees fit.

Account Activation
By activating your account with Jweeb Solutions, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.

NOTICE: If you sign up for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by e-mail or phone prior to taking any action to provide you with an opportunity to correct the problem.

Support and Support Response Guarantee
Although Jweeb Solutions has an excellent record for support, we do not offer any support response time and/or resolution guarantee. Support can only be obtained from support@jweeb.com.sg (Jweeb Solutions Hosting) and support@hostnsmile.com (Host ‘n’ Smile).

Server Uptime Guarantee
Although Jweeb Solutions has an excellent record for reliability, we do not offer an uptime guarantee. However, our network and servers are monitored continuously, and are rarely down except for scheduled maintenance and hardware and software upgrades.

Jweeb Solutions reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.

 

Domain Name Services (Standard)

Domain Name Registration is the subscription of domain names, i.e. .com, .net, .com.sg, .sg. Domain Name services are provided through our partner IP Mirror Pte Ltd and clients are subjected to the agreement both found on this page, as well as at: http://www.ipmirror.com/AboutUs/agreement_domains.html.


Control Panel Access
Control Panel Access would be given to clients upon request only. The account would be initially setup during the domain name registration with the email address provided. Jweeb Solutions does not have control over the change of ownership of the domain name or its contact details. The client is responsible for self-updating the latest information. Clients are able to use domain name services on the control panel. Domain Name prices on the Control Panel are based on IP Mirror's pricing.

Domain Name Transfers (In)
Clients would need to provide the auth code and unlock the domain name should the domain name be transferred from a 3rd party registrar to Jweeb Solutions. Domain name transfers must be made at least 21 days before the expiry of the domain name. Jweeb Solutions would not be liable for the delay caused in processing the domain name or the inability to transfer the domain name if it is rejected by the domain name registrars during the transfer process.

Payment, Cancellation and Refunds
Domain name services are usually made based on an annual basis, otherwise stated. Domain name cannot be cancelled or refunded when the order has been confirmed together with payment. The ownership of the domain name remains with Jweeb Solutions unless payment is made in full. Payments must be made within 10 days upon domain name registration order confirmation.

Renewal
Domain names are subjected to renewals upon its expiry. Clients are responsible for renewing the domain name at least 14 days before the date of expiry. Jweeb Solutions would not be responsible for ensuring the renewability of this domain name within 14 days of expiry. Domain names may result in additional administrative charges during this period.

Transferring Out
Domain Name Transfers (out) of Jweeb Solutions need to be requested at least 28 days before  expiry. Jweeb Solutions may impose additional charges or may not entertain the transfer request within 28 days of expiry.

Expiry of Domain Name
Upon the expiry of the domain name, the domain name would be discontinued. The client's websites and email accounts affiliated to the expired domain name will be disrupted. Activitating a expired domain name would require a reinstatement fee. As the reinstatement fee is costly, Customers are advised to renew their domain names at least one month before expiry.

Services Rates
We may proactively change the rates and charges from time to time.

Free Domain Names
Free Domain Names offered to customers by Jweeb Solutions would not be allowed to transfer out their domain name from Jweeb Solutions until a subsequent year renewal fee at the published fees is made. 

Free .com.sg / .sg SME Domain Name
Domain Names registered under this promotional scheme would not be allowed to be transferred out from Jweeb Solutions until a subsequent year renewal fee at the published fees is made.

Other Promotions
Customers are to refer to the domain name agreement set forth by the Domain Name Registrar, IP Mirror found at http://www.ipmirror.com/AboutUs/agreement_domains.html.

The following terms apply if the domain name order mentions "budget" in the domain name order, invoice and/or receipt.

The default domain name's nameservers would be set at Jweeb Solutions Servers. An administrative fee of S$2.50 (exclusive of the prevailing GST Rate) would be chargeable for every change of its nameservers per domain name.

Registrant Ownership Records
An administrative fee of S$15 (exclusive of the prevailing GST Rate) would be chargeable for the change of the registrant ownership records to the client's name.

We may proactively change the rates and charges from time to time.

 

Google Apps Website Essentials: Setup & Training

By purchasing, using or subscribing to Google Apps Website Essentials: Setup & Training through the Training & Education Division of Jweeb Solutions, the following terms apply:

One Time Setup
The One-Time Setup only includes: The registration of Google Apps, the activation of Google Apps for the chosen domain name, the configuration of the domain name settings to enable the domain name to be active with Google Apps for Sites and Email (i.e. cname and MX Entries), and the configuration of the domain name (
www.something.com) to redirect to the first operational website, and a subdomain (mail.yourdomain.com) to point to the web-based email account for login.


2 Hours Training
A maximum of two hours one-one hands-on, on-site training for Google Apps: Sites and Email is provided at selected areas of Singapore deemed easily accessible by Jweeb Solutions. Known accessible areas include the Central Business District Area, Orchard, Novena, Paya Lebar, Kallang, Aljunied, Boon Keng, Lavendar, Bugis, Tiong Bahru, Toa Payoh, Potong Pasir, MacPherson, Ubi and Kaki Bukit. A S$45 NETT transporation surcharge would be applicable for areas not deemed accessible. No group discounts would be provided should clients prefer a group training. Should the client's computer be used, the, The client is recommended to have a computer available with the latest version of any of the following browsers: Internet Explorer, Mozilla, Chrome. The browser, computer and internet network must allow Javascripts to be run. The training would only cover the contents of the user guide, and the essentials of using Google Apps Sites. Advance features on Google Apps may not be available in this training. Training is provided in the English Language only.




 

Full Color User Guide
The latest version of the available user guide would be provided to the trainee in color and in hardcopy. Jweeb Solutions is not liable for the accuracy of content in the user guide. Should a newer version of the user guide be published at a later date, clients are able to purchase it at S$30 (with Postage - Additional S$5).


Search Engine Submission
The search engine submission only submits to a minimal of three search engines - Google, MSN and Yahoo. The search engine submission does not guarantee a good search result listing of the website. The search engine submission is only available for the first operational website that the client has created. The client is to provide the necessary meta keywords, site name and site description for the submission.


1 Year .com Domain Name
A .com TLD domain name is provided for clients. The client is required to renew the domain name on a second year before the domain name is allowed to be transferred out of Jweeb Solutions. The renewal rate is based on the Recommended Retail Rates of the Domain Name. Other domain name extensions are available on a top-up basis on the price difference. Should the perferred and alternate domain name available, Jweeb Solutions would inform the client to have other domain name alternatives. It is not mandatory for Jweeb Solutions Staff to provide domain name suggestions.


1 Year DNS Hosting
A Control Panel is provided to clients to modify the DNS settings of the domain. Such settings could include MX Settings, Sub Domains, URL Redirections, cName, A Records, amongst others. Renewal rates would be based on the prevailing Recommended Retail Rates of DNS Hosting.

DNS management is handled via http://www.jweeb.com/cpanel with the provided username and password. Support for DNS management is provided by Jweeb Solutions. The client would need to provide the appropriate DNS Type and Settings to the support team, contacted support@jweeb.com or contact@jweeb.com.sg.


2 Months User Support
A 2 months user support for questions with regards solely to the use of the general settings of Google Apps, use of Google Sites and Google Email. Jweeb Solutions would provide instructions or guide the user to achieve the required objectives, based on the capabilities of Google Apps: Sites & Email. Users can alternatively use Google’s Online Help to get help. 
Support for other Google Apps applications are not provided in this user support. The communication is through email and in the English Language only. Once the User Support with Jweeb Solutions has expired, the user is to contact Google directly for Support pertaining to the use of Google Apps. The user can also use Google Help Pages for additional end-user support. Google Apps Technical support is not handled by Jweeb Solutions, the user is to contact Google directly for support.

An additional 10 Months of user support can be provided at a special top-up rate at S$50. This is to be paid within 2 weeks upon the activation and setup of the web hosting and domain name. This special price is only valid for the first year only. Should user support be obtained later, support is charged at S$10 a month for a minimum period of 6 Months. Should the user take up the first year user support offer, user support is renewable at $10/month from the 2nd year onwards. It would also be automatically reflected on the renewal invoice, and could be removed upon request.

 

Pre-Training Form
The client is expected to fill in a pre-training form on softcopy. The form is help Jweeb Solutions provide the initial setup of the first website and to submit the first operational website to the search engines. The contents on the form may not be changed upon submission. The client is to check the accuracy of the form before submission. The setups and submissions would be based on the contents of the form. 


Payment
Payment is to be made before the services are rendered, otherwise mentioned. All paid fees are non-refundable.


Website Uptime
As the client’s website and email accounts are stored on Google’s servers, Jweeb Solutions is non-liable for any downtime caused to the user’s websites. The client is to contact Google’s technical support for such issues.

 

Terms Explained

Visual Concepts: Refers to the design draft/s presented to the client for selection.
Revisions: Refers to the change/s that can be made to the visual concept selected.
Colors: Refers to a visual shade. White is defined as a color.
Color Mode: Refers to the format of colors such as CMYK, RGB and Pantone.
Resolution: Refers to the number of dots per inch (dpi) of the image.
Pixels: Refers to the number of dots in an image.
Size: Refers to the physical dimensions of an image.
Uptime: Refers to the duration of the servers being connected and accessible to the World Wide Web.
Downtime: Refers to the duration of the servers being disconnected and inaccessible to the World Wide Web.
Bandwidth: Refers to the volume of data being transferred to and from the server.
Disc Space: Refers to the storage amount of data on the server.
cPanel: Refers to the Web Hosting Control Panel.
Fantastico: Refers to the automated script installer found on the user's cPanel.
PHP: Refers to a computer programming language.
Ruby on Rails: Refers to a computer programming language.
VBA: Refers to a computer programming language.
Java: Refers to a computer programming language.
JSP: Refers to a computer programming language.
HTML: Refers to a computer programming language.
CSS: A style sheet language used to define the presentation of a document written in a markup language (i.e. HTML).
CGI: Refers to a computer programming language.
Pearl: Refers to a computer programming language.
Java Scripting: Refers to a computer programming language.
C++: Refers to a computer programming language.
XML: Refers to a computer programming language.
Domain Name: Refers to the hostname that identifies a computer.
Web Design: Refers to the visual design (or the visual static component) of the webpage.
Web Development: Refers to the programming of a computer script or writing a computer program.
Hosting: Refers to the storage of the website files on a web server connected to the World Wide Web.
